MUTUAL RECOGNITION - DOUBTS


  • It may not work because the directive also allows:
    • a Member State to refuse this recognition if it can be justified on the basis of protecting workers' health; and

  • adjustment of conditions of authorisation if a Member State establishes that:
    • (a) the target species is not present in harmful quantities,
    • (b) unacceptable tolerance or resistance of the target organism to the biocidal product is demonstrated, or
    • (c) the relevant circumstances of use, such as climate or breeding period of the target species, differ significantly.
