The Biocidal Products Directive/RegulationsThe European Commission have published the 3rd Review Regulation, which includes revised lists of 'Notified' and 'Identified' biocidal active substances. It also lists the Member States responsible for the reviews for the 3rd and 4th Review Groups. The list of 'Notified' substances as produced in a provisional list prior to publication of the 2nd Review Regulation can be viewed and searched on this website here. Following publication of the UK Biocidal Products Regulations, HSE have published several other BPR related documents:
HSE have also published Regulations on the General Industry Charge - S.I. 2003 No 429. As anticipated, the charge will be a flat rate per company and that this will extend to active manufacturers as well as formulators. The charge in the first year was estimated at £333 per company and was billed in mid 2004. In Europe, The Commission has published decision papers on most of the borderlines between the BPD and other Directives. These are published separately from the 'Manual of Decisions'. All these documents can be found on the website of DG Environment in the European Commission: http://europa.eu.int/comm/environment/biocides/index.htm Technical Notes for Guidance on a number of topics have been published by the European Chemicals Bureau (ECB). These cover Annex I inclusion, Data requirements, Dossier preparation and study evaluation, Human exposure and Product evaluation. These and other documents can be downloaded from the ECB website: http://ecb.jrc.it/biocides/ (click on the DOCUMENTS tab) Dangerous Preparations Directive/CHIPThe new Preparations Directive (1999/45/EC) has now been implemented across the EU. This introduced, for the first time, requirements to label preparations for environmental hazards including, if necessary, application of the dead fish/tree symbol. It also requires all formulations that contain 0.1% or above of a sensitiser to bear the inscription "Contains 'name of sensitiser'. May produce an allergic reaction.". In the UK this has been implemented by CHIP 3. Indeed, the CHIP 3 Regulations have been published as 'The Chemicals (Hazard Information and Packaging for Supply) Regulations 2002; S.I. 2002 No. 1689. The Regulations came into force on the 24th July 2002 and the advice is therefore to consider your reclassifications as soon as possible. ChemLaw is ready to help. EC Strategy for Future Chemicals PolicyThe European Commission published its proposal on REACH (Registration, Evaluation, Authorisation and Restrictions of Chemicals) on the 29th October 2003. It is only currently available on the web: http://europa.eu.int/eur-lex/en/com/pdf/2003/com2003_0644en.html This will introduce a regime similar to that introduced by the Biocidal Products Directive for all chemicals. Since then, industry has been active in producing position papers. Because so much work has gone into this document, the expected 29th ATP to the Dangerous Substances Directive was severely delayed but has now been published (see below). 29th ATP PublishedThe European Commission has published the 29th ATP to the Dangerous Substances Directive on the 30th April 2004 as: Commission Directive 2004/73/EC of 29 April 2004 adapting to technical progress for the twenty-ninth time Council Directive 67/548/EEC on the approximation of the laws, regulations and administrative provisions relating to the classification, packaging and labeling of dangerous substances.
